The following provisions apply between the landlord and the tenant (contractual partner): These general terms and conditions and rental conditions for house and dog regulations form part of this guest accommodation contract and are sent on request or are available for inspection in the holiday apartment. By sending the tenant's booking confirmation to the broker or landlord, the tenant fully accepts these conditions for himself and all accompanying persons. Definition of the operating mode holiday apartment Maximum occupancy 5 people or number of people according to booking confirmation A holiday apartment is a self-contained accommodation within a house with its own sanitary area and self-catering facility, in which guests are accommodated for a temporary stay. Grilling food outside the apartment is only allowed with the landlord's consent. Rights and obligations: 1. The guest accommodation contract is concluded as soon as the apartment has been ordered and agreed with the landlord or his agent. 2. The conclusion of the guest accommodation contract obliges the contractual partners to fulfill the contract, regardless of the duration for which it was concluded. 3. The landlord reserves the right to unilaterally terminate the accommodation contract if the agreed down payment amount or the remaining payment amount according to the booking confirmation has not been received by the guest on time or in full on the bank account specified in the booking confirmation. In this case, the total amount of guest payments minus a processing fee of EUR 30.00 will be transferred back to the guest's bank account immediately. Further claims of any kind of guest against the landlord are excluded.
4. The landlord is obliged to compensate the tenant (contractual partner) if the apartment is not provided. The amount of the compensation is based on the legal regulations and provisions of the DEHOGA (German Hotel and Restaurant Association). 5. The lessee (contractual partner) is obliged to pay the agreed price if the contractual services are not used or canceled, less the expenses saved by the lessor. The saved expenses are included in the following cancellation conditions if not otherwise rented: Cancellation conditions: A processing fee of EUR 30.00 will be charged to the guest in addition to the following cancellation costs. Cancellation takes place up to 360 days before arrival: 10% of the agreed total rental price Cancellation takes place up to 180 days before arrival: 20% of the agreed total rental price Cancellation takes place up to 90 days before arrival: 40% of the agreed total rental price Cancellation takes place up to 60 days before arrival: 60% of the agreed total rental price cancellation takes place up to 30 days before arrival: 80% of the agreed total rental price cancellation takes place less than 30 days before arrival and in the event of non-arrival: 90% of the agreed total rental price change and change requests of the guest EUR 20 due for the cancellation fee: immediately and without being requested after cancellation to the bank account mentioned in the booking confirmation The tenant can prove less damage at any time. If the tenant cancels the stay prematurely, he remains obliged to pay the full rental price. Cancellation or termination can only be made in writing. The day of receipt of the declaration by the landlord is decisive. The landlord will immediately notify the tenant (contractual partner) of a different lease in the rental period not used by the tenant (contractual partner) and will offset the existing claims of the landlord and any reclaims from the tenant (contractual partner). We recommend taking out cancellation insurance. 6. The landlord is held in good faith to rent unused holiday apartments to other people if possible to avoid breakdowns. Until otherwise awarded, the tenant (contractual partner) has calculated the duration of the contract according to section 4 Amount to be paid. 7. Liability and obligations of the lessee (1) The rental property, including the furniture and other objects contained in it, must be treated with care. The tenant has to stop the accompanying and / or visiting persons with care. The tenant is liable for culpable damage to the rental property, the furniture or other objects in the rental property by him or accompanying persons. (2) Defects that arise when the rental property is taken over and / or during the rental period must be reported to the lessor immediately in a suitable form. (3) The keeping of animals in the rental property is only permitted after prior agreement with the landlord and written confirmation by the landlord. (4) Visitors of the guest Visitors of the guest are to be registered by the landlord and approved by the landlord. The maximum length of stay for visitors is 2 hours per day with the approval of the landlord. (5) House rules: The tenant undertakes to adhere to the house rules for all registered or visiting persons, himself and all groups of people mentioned. This is available in the rental property. (6) The bringing in and storing of dangerous substances of any kind is prohibited. (7) Open fire is prohibited in the holiday apartment and outdoors on the entire property. (8) All personal belongings and property of the lessee and his registered persons, including short-term visitors approved by the lessor, are to be taken away from the apartment or the property at the latest when the agreed rental period expires. Any liability of the landlord for personal items or property of these people is excluded. 8. Apartment prices include the use of rented and public facilities of the accommodation company. VAT is included as far as there is a VAT obligation. If the length of stay is shorter (up to 5 nights), the landlord is entitled to request surcharges for the overnight stay.
9th Rental price payments Insofar as a down payment has been agreed in the booking confirmation, the tenant (contractual partner) must make this on time. The deposit must be credited to the bank account specified in the booking confirmation by the 3rd day after receipt of the booking confirmation by the landlord (contractual partner), and the remaining payment 7 days before the day of arrival. The landlord can unilaterally terminate the accommodation contract (see 3.) 10. Surcharge for late payments For late payments or final payments, the tenant will be charged EUR 2.00 per late day of receipt of payment in the bank account of the Haus Luge apartment and is immediately due for payment. 11. Spa fee * Spa fee of the Tourist Information Winterberg The spa fee of € 1.95 per person / night for people aged 16 and over is not included in the total rental price. This must be paid on the day of arrival. * The city tax is not guaranteed. 12. WLAN Internet access The landlord provides free WLAN Internet access at the request of the lessee. The conditions for the use of the WLAN Internet access are made known to the guest and must be recognized by the guest before use. 13. Liability The tenant assures the landlord that he is actively providing adequate insurance protection through liability insurance for damage to or on the rental property caused by the tenant himself or by people traveling with him and that the insurance premiums are paid in full to the insurance company without any arrears. The use of the apartment and the associated facilities is at your own risk for the tenant (contractual partner) and all fellow travelers. The landlord is not liable for the risks from the accommodation of ski equipment or other valuables of the tenant even outside of the apartment. The landlord is not liable for damage caused by force majeure, accident or theft, nor can the landlord be held liable for damage to skis, bikes or cars. In the garden area of the apartment Haus Luge is a garden pond. In order to prevent damage to life and limb, it is important, especially with children, to be careful not to get near the garden pond.
